The PADEP Land Recycling Program is making changes to the Short List of Petroleum Products presented in the Land Recycling Program Technical Guidance Manual (TGM), Section IV.E.3. Proposed changes were published in the PA Bulletin on August 4, 2007, and the public comment period ended on September 4, 2007. The final changes will be published in the PA Bulletin on March 15, 2008 and will become effective March 15, 2008.

The TGM will be updated with the new Petroleum Short List information effective March 15, 2008.
The purpose of the petroleum short list is to provide a convenient method for remediators to conduct site characterizations and demonstrate attainment of cleanup standards involving petroleum products that include hundreds of substances. If the remediator remediates the substances listed on the short list, and complies with all other conditions specified in the TGM, then the Department will be satisfied that the petroleum product is remediated in accordance with the cleanup standards. Experience with the current short list has shown that even when attainment is demonstrated for the substances on the list, other substances contained in the petroleum products may still exist in the environment at concentrations exceeding the established statewide health standards. The current list is being revised to address those substances.
The Department is making the following changes to the petroleum short list:
- Add both 1,3,4-trimethyl benzene (also known as 1,2,4-trimethyl benzene) and 1,3,5-trimethyl benzene to the leaded gasoline, aviation gasoline and jet fuel category; the unleaded gasoline category; the kerosene and fuel oil No.1 category; the diesel fuel and fuel oil No.2 category; and the mineral insulating oil category.
- Add MTBE to the kerosene and fuel oil No.1 category; and the diesel fuel and fuel oil No.2 category.
- Delete the semi-volatile substances fluorene and phenanthrene from the kerosene and fuel oil No.1 category; and the diesel fuel and fuel oil No.2 category
The Department is adding the following language to the TGM to facilitate a smooth transition to using the new short list:
This short list of petroleum products may be revised from time to time as determined necessary by the Department. For those sites in the Corrective Action Process or for which a Notice of Intent to Remediate has been filed prior to the date a revised list becomes effective and for which site characterization is underway, attainment demonstration will be made using the old list of substances. Sites which commence investigations to characterize or verify releases after the date the new list becomes effective, whether under the Act 2 regulations or the Storage Tank Corrective Action Process, will use the new list for characterization and attainment demonstration purposes.
The Department intends to determine if an investigation is "underway" based on the submission of samples to a laboratory for analysis. No revisions are being made to the general section in the TGM relating to the "Short List of Petroleum Products"; TGM Section I.D.4, page I-10.
